We may at any time revise these Terms and Conditions by updating this posting and changing the effective date indicated above. You are bound to the terms and conditions at your time of purchase. You should therefore review this page in relation to your purchase date. A log of changes to these terms can be found after point 19. Anything which is not found in the change-log will apply to all customers.

1. PARTIES

"Client”, “You” and “Your” refers to you, the person logged on this website and compliant to the Company’s terms and conditions." Your access to and use of the Site is also subject to the following terms and conditions (“Terms and Conditions”) and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms and Conditions and agree to be bound by all of these Terms and Conditions.

2. AGE REQUIREMENT

You must be 18 years of age or older to use or place an order on this Site. By submitting information through the Site, you represent that you meet this age qualification.

3. ORDER ACCEPTANCE AND SHIPMENT

Your placement of an order does not necessarily assure that we will accept your order. We may require additional information regarding your order if you have not provided all of the information required by us to complete it. While the Companies will use commercially reasonable efforts to process orders placed on the Site within the timeframes specified at the time the order is placed, the Companies cannot guarantee that orders will be processed, or received, by a particular date. The Site does not accept orders from dealers, wholesalers, or other customers who intend to resell items offered on the Site.

The purchase can be considered “accepted” when you receive the electronic order confirmation sent to your email.

4. SHOPPING, PAYMENT AND TAXES

4.1 UNITED STATES: Safeback AS is a Norwegian corporation which controls and operates the Site from their offices in Norway, and all information is processed within Norway. They do not represent that materials on the Site are appropriate or available for use in other locations. Persons who choose to access the Site or purchase products from the Site from locations outside of the United States do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable. You agree to comply with all applicable laws, rules and regulations in connection with your use of the Site. If you access the Site from locations outside the United States you agree that any information you provide to or though the Site may be processed in the Norway. In terms of payment, we use state of the art SSL technology to keep your credit card information safe. You can use credit cards: VISA, Mastercard, Maestro, and American Express. Prices are stated in US dollars. Customers will be charged applicable sales tax, which will be reflected in the amount show when the customer checks out. You will be charged when the purchase is registered in our online store, with our available payment methods.

4.2 CANADA: Safeback AS is a Norwegian corporation which controls and operates the Site from their offices in Norway, and all information is processed within Norway. They do not represent that materials on the Site are appropriate or available for use in other locations. Persons who choose to access the Site or purchase products from the Site from locations outside of the Canada do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable. Orders to Canada are fulfilled by warehouses in the United States, and shipped over the border to the end customer. Safeback AS will handle all orders to Canada, but customers will have to pay the local tax and the direct customs fee to local authorities when receiving our products. Safeback AS is not responsible for the local regulations in Canada, and customers are buying our products at their own risk. Safeback AS encourages all Canadian customers to confirm these regulations with your local authorities before ordering. In terms of payment, we use state of the art SSL technology to keep your credit card information safe. You can use credit cards: VISA, Mastercard, Maestro, and American Express. Prices are stated in Canadian dollars. You will be charged when the purchase is registered in our online store, with our available payment methods.

4.3 EUROPEAN UNION: Safeback AS is registered (NO820851242), and operates out of Norway, under Norwegian law. Safeback AB is also registered as a VAT (sales tax) applicable company in Sweden (Org. 559418-5760) – our customs point of entry when shipping goods to the EU. Therefore, all shipments to our EU residents will be automatically invoiced with the Swedish VAT of 25% included in the price. The sales tax may most likely not be refundable or deductible in your country, local exceptions may apply. All products are ship DDP (Delivered Duty Paid) to a private person within the EU. In terms of payment, we use state of the art SSL technology to keep your credit card information safe. You can use credit cards: VISA, Mastercard, Maestro, or American Express. Purchases can only be made in the currency available for the country where you choose your delivery to be made. You will be charged when the purchase is registered in our online store, with our available payment methods.

4.4 NORWAY: Safeback AS is registered (NO820851242), and operates out of Norway, under Norwegian law. Therefore all shipments to Norwegian residents will be automatically invoiced with the Norwegian MVA of 25% included in the price. All products are ship DDP (Delivered Duty Paid) to a private person in Norway. In terms of payment, we use state of the art SSL technology to keep your credit card information safe. You can use credit cards: VISA, Mastercard, Maestro, and American Express. Prices are stated in NOK. Purchases can only be made in the currency available for the country where you choose your delivery to be made. You will be charged when the purchase is registered in our online store, with our available payment methods.

Where these terms of sale require a written confirmation, this is fulfilled by using e-mail or text message to mobile phone (SMS).

4.5 SWITZERLAND: Safeback AB is registered as a VAT (sales tax) applicable company in Sweden (Org. 559418-5760) – our customs point of entry when shipping goods to Europe. Since Switzerland is outside the European Union we will not charge Swiss customers with Swedish VAT. Safeback AS will handle all works to Switzerland, but customers will have to pay the local VAT (8%) and the direct customs fee (estimated to be around 2€) to local authorities when receiving our products. Safeback AS is not responsible for the local regulations in Switzerland, and customers are buying our products at their own risk. Safeback AS encourages all Swiss customers to confirm these regulations with your local authorities before ordering. In terms of payment, we use state of the art SSL technology to keep your credit card information safe. You can use credit cards: VISA, Mastercard, Maestro, and American Express. Prices are stated in CHF. You will be charged when the purchase is registered in our online store, with our available payment methods.

5. DELIVERY AND DELAY

Delivery of the products takes place in the manner, at the place and at the time stated on the order confirmation. Usually 2 - 7 business days. We have the risk for the products until they are taken over by you, ie when you have received the products in your possession. If the delivery of the products is delayed, we will provide you with information as soon as we know about it, together with information about and possibly when delivery can take place, or if the product (s) are sold out. You can follow your orders under "Account”

5.1 PARTNER “DROP-SHIPPING”: Safeback works with the companies who produce compatible backpacks (“Backpack Partners”) in order to send out orders to your stated shipping address. To fulfill an order, your information must be shared by Safeback, to our Backpack Partners in order for orders to be fulfilled. By purchasing through our website, you accept that your information will be sent on to the relevant backpack producer.

6. RETURNS AND THE NORWEGIAN CANCELLATION ACT

The Norwegian Cancellation Act gives you the right to cancel your purchase. The right of withdrawal applies to goods and to certain services (see exceptions in the last section). The right of withdrawal presupposes that you notify us of this within 14 days of receiving the delivery (withdrawal period). When returning Christmas gifts, the person who ordered the gift must return it. The refund will then be made to the card registered. When changing size, you must order the item again. For the right of withdrawal to be enforced, the product must have been delivered to us in approximately the same quantity and condition as you received it.

All products must be returned to us or our partner warehouses within a 14 days. Cased may exist where our Partner drop-shipping arrangements send a return label covering the cost of your return. In all other cases, you are responsible for the cost of shipment, and are responsible for its arrival to our receiving warehouse. Refunds must be made within fourteen days after we receive the product from you or collection note or the product is made available to us. You will be notified via email after your refund has been accepted.

The product is sent back to us, if possible in original packaging, together with the right of withdrawal form and receipt.

Refunds will be issued to your payment card after returned goods have been processed.

7. WEBSITE CONTENT

You may download material displayed on the Site for non-commercial, personal use only, provided you also keep all copyright and other proprietary notices contained on the materials. You may not, however, distribute, modify, transmit, reuse, re post, or use the content of the Site for public or commercial purposes, including the text, images, audio, and video without the Companies prior written permission. You should assume that everything you see or read on the Site is copyrighted by the Companies or its licensors unless otherwise noted and may not be used except as provided in these Terms and Conditions without the written permission of the Companies. While the Companies uses reasonable efforts to include accurate and up to date information in the Site, we make no warranties or representations as to its accuracy. We assume no liability or responsibility for any errors or omissions in the content of the Site.

Images of people or places displayed on the Site are either the property of or used with permission by the Companies. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms and Conditions or specific permission provided elsewhere on the Site. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

The trademarks, logos, and service marks (collectively the “Trademarks”) displayed on the Site are registered and unregistered trademarks of Safeback and its licensors. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of Safeback or such third party that may own the Trademarks displayed on the Site. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms and Conditions, is strictly prohibited. You are also advised that the Companies will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

8. INACCURACY DISCLAIMER

From time to time there may be information on the Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. Without limiting its rights provided elsewhere in these Terms and Conditions, the Companies reserves the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after you have submitted your order). We have made every effort to display the colors of products as accurately as possible. However, we can’t guarantee that your computer monitor’s display of any color will be accurate.

9. LINKS

The Companies does not endorse the content of any third-party websites. The Companies is not responsible for the content of linked third-party sites, sites framed within a third-party website, or third-party advertisements, and does not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites.

10. LOCATION OF USE

The Site supports sale in: Norway, the EU, Switzerland, the United Kingdom, the United States, and Canada.

Safeback AS controls and operates the Site from our offices in Norway, and all information is processed within Norway. We do not represent that materials on the Site are appropriate or available for use in other locations. Persons who choose to access the Site or purchase products from the Site from locations outside the explicitly named countries of availability do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable. You agree to comply with all applicable laws, rules, and regulations in connection with your use of the Site. If you access the Site from locations outside of the specified countries above you agree that any information you provide to or though the Site may be processed in Europe.

11. TERMINATION OF ACCESS

The Companies may terminate your access, or suspend your access to all or part of the Site, without notice, in The Companies sole discretion. Such termination or suspension of access may occur, without limitation, for any conduct that The Companies, in its sole discretion, believes is a violation of these Terms and Conditions, is in violation of any applicable law, or is harmful to the interests of another user, customer, recipient, licensor, content or service provider, The Companies, or its affiliates.

12. WAIVER AND SEVERABILITY

The failure of The Companies to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.

13. WARRANTY AND FAULTS OF RECEIVED GOODS

The warranty period is 2 years from the date of purchase by the end customer. The warranty can be extended by 1 year by all customers, regardless of their point of purchase, by completing the device registration form, found on the “My Account” page of the Site. All information from the device registration form is processed and stored in Norway.

​This limited warranty does not cover damage caused by accidents, incorrect use, normal wear and tear, fire, sharp edges (such as crampons, skis, snowboards, snowmobiles, rocks, etc.), fading of colors due to extended UV exposure, misuse, improper assembly, failure to follow recommended care and maintenance procedures, improper or incorrect maintenance or repairs by anyone other than an authorized Safeback dealer, use of parts or devices not conforming to the products, and modification of the product.

If your product, which you have purchased from an authorized sports retailer or directly from us, is nevertheless defective in material or production, we will repair or replace the item free of charge within 2 years.(3 years if registered on the Site)

13.1. What does the warranty cover?

All physical products manufactured by Safeback and Safeback on safeback.no or from our authorized partners and their resellers (the "Product") after September 1st, 2023, used in a manner compatible with the Product's intended use, are covered by the warranty set out in this provision (the "Warranty").

The warranty period is 2 years from the date of purchase by the end customer. The warranty can be extended by 1 year by all customers, regardless of their point of purchase, by completing the device registration form, found on the “My Account” page of the Site. All information from the device registration form is processed and stored in Norway.

The Warranty is limited to manufacturing defects, meaning any deviation from design specifications during production of the Product resulting in a Product's defect, frailty or shortcoming during normal use ("Defects"). Defects include, but is not limited to, unintended physical damage to the components the Product, construction defects of the Product, electronic malfunction.

This Warranty is valid only for the period of time the Products is owned by the original purchaser or recipient (if gift) of the Product.

If your Product is damaged in a way that is covered by the Warranty, Safeback shall at its own cost repair or replace the defect part of the Product that is covered by the Warranty. Transportation costs will be covered by Safeback.

13.2. What does the warranty not cover?

The Product shall be handled with due care. The Warranty does not cover wear and tear, resulting from an abnormally harsh use or use that is not compatible with the Product's intended use.

Neither does the Warranty cover cosmetic damages, replacement of any non-defective pieces of the Product, any product sold "as is", "preconditioned", used" or any other similar wording indicating that the Product is not new, changes in fabric that are inherent in the normal use of the Product, changes in color over time, chipping of metal or painted elements, or loss of functionality due to consumers being locked out of their Product.

The Warranty only covers one repair of the same defect/replacement of the same component. In other words, if the same damage occurs several times, the additional damages are not covered by the Warranty

Damages caused by transport and transit damage are not covered by this Warranty. The Warranty must be claimed within a reasonable time after the damage occurred. Increased damages due to a lack of claim are not covered by the Warranty.

Repairs or replacement of damages of the Product will not extend the Warranty Period. Any repairs or replacements are only covered by the Warranty for the remains of the Warranty Period.

14. DISPUTES

14.1 – Process

The parties shall endeavor to resolve any disputes amicably. If this does not succeed, you can bring the case to the Consumer Council near where you live. All disputes shall be resolved in accordance with Norwegian law. By purchasing in safeback.no you accept that Norwegian legislation shall apply. If the case is brought before the courts, it must be decided in your (buyer's) venue, ie normally near where you live. 14.2 - Governing Law

For all customers in Norway, these Terms shall be governed in all respects by the laws of Norway, without regard to its conflict of law principles. You agree that any claim or dispute you may have against Safeback must be resolved by a court located in Bergen, Norway. You agree tosubmit to the personal jurisdiction of the courts located within Norway for the purpose of litigating all claims or disputes.

1. USER CONDUCT AND SECURITY

You agree to use the Site only for lawful purposes. You agree not to take any action that might compromise the security of the Site, render the Site inaccessible to others, or otherwise cause damage to the Site or its content. Attempting to interfere in any way with the Site’s networks or network security, or attempting to use the Site to gain unauthorized access to any other computer system.

Violations of system or network security may result in civil or criminal liability. The Companies will investigate and may involve law enforcement authorities in prosecuting the user or users who are involved in such violations.
